The purpose of the Quebec Pay Equity Act is to redress differences in compensation due to systemic gender discrimination suffered by persons who occupy positions in predominantly female job classes.

Every enterprise that is under provincial jurisdiction and has an average of ten employees or more is subject to the Act. The requirements of an enterprise differ depending on its size.

 

* An enterprise whose number of employees is fewer than 50 (10 to 49 employees) shall establish a pay equity plan, submit a pay equity report annually and have their audit done every five years.

 

* An enterprise whose number of employees is between 50 and 99 shall establish at least one pay equity plan, submit a pay equity report annually and have their audit done every five years.

 

* An enterprise whose number of employees is more than 100 shall establish at least one pay equity plan, submit a pay equity report annually and have their audit done every five years. Furthermore, the employer must set up a pay equity committee to establish their pay equity plan.

 

From the time an employer becomes subject to this Act, every person on whom this Act imposes obligations remains subject to those obligations on the same terms, regardless of any change in the number of employees in the enterprise.
